Have you ever purchased something under a finance agreement where what you thought you were buying and what you ended up buying was something different? Take the example of buying a car from a dealership for say £30,000, where they guarantee to buy it back from you for £20,000 in 4 years' time providing you drive no more than 10,000 miles per year. On the face of it this seems fine, however, what if you later discovered that this would only apply if you had your car MOT'd and serviced by the same dealership once a year?

Another example, what if you purchased a product whereby, for 15 years you would get the benefit of the product, and at the end of the 15th year the product would be resold, and you would receive a percentage of the proceeds. In many instances this may appeal, however, what if the product related to an investment in property, and you were left unaware of how the seller would dispose of the property at the end of the term, yet the seller knew the specifics about how the property would be sold?

In both the above examples there is an imbalance of knowledge between the buyer and the seller. This is termed as an 'unfair relationship.' Where the seller has sold the product under a Finance Agreement you can pursue a claim for compensation under Section 140 of the Consumer Credit Act 1974
