Businesses often seek the services of an "energy broker" to get the best possible deal for their electricity supply. Many "energy brokers" notify their customers what their fee will be for negotiating a deal with a supplier, but historically some have not. If the energy broker does not charge their client a fee, then they should indicate if they will be paid a fee by the supplier.
If the "energy broker" does not indicate how they will be paid and receive a fee from the supplier, then this is deemed to be a "secret commission." Where a contract has been signed on this basis, then potentially a claim for compensation may arise. If the broker has not informed their client that they will receive a fee, then they may have breached their "fiduciary duty" to their client as they are expected to be working in their client's "best interests."
Both the broker and the electricity supplier should ensure that the end user is aware of the arrangement between the parties. Both may be held jointly and severally liable for any claim as there is deemed to be an Agency Agreement in place between the two parties.
Claims for "undisclosed commissions" for these types of cases are likely to be more successful where the contracts make no reference to the broker receiving a fee from the energy provider. These may be more prevalent in contracts that are more than 6 years old. Many recent contracts issued have accounted for the broker being paid a fee as it would be inconceivable that a client of the broker would expect him to work for nothing.
Please be aware that if your contract indicates that your broker "may" receive a fee then it is unlikely that you will be able to successfully claim compensation as this is deemed only to be a "half-secret commission" and it may be deemed that you should have asked the broker more questions as to how their fee is generated.
